Terms of Service

Last updated: September 30, 2026

These terms govern your use of portablemind. By creating an account or using the service, you agree to them.

This document describes our current practices in plain language. It is not legal advice.

The agreement

This is an agreement between you (or the organization you represent) and Portablemind LLC. If you are accepting on behalf of an organization, you confirm you have authority to bind it.

Your account

You are responsible for the accuracy of your account information, for keeping your credentials secure, and for activity that happens under your account. Tell us promptly if you believe an account has been compromised. Accounts are for a named person and are not to be shared.

Acceptable use

You agree not to use portablemind to:

  • Break the law, or infringe anyone else's intellectual property or privacy rights.
  • Upload malware, or attempt to gain unauthorized access to the platform, other tenants, or any connected system.
  • Probe, scan, or stress-test our infrastructure without our written permission.
  • Use AI features to generate unlawful content, or to impersonate a real person or organization deceptively.

We may suspend access where use threatens the security, integrity, or availability of the platform for others. Where circumstances allow, we will tell you first.

Building on portablemind

We want you to build on portablemind. Applications, integrations, and products for your own customers that use our agents, orchestrations, and APIs are welcome. What you may not do is use the platform to rebuild the platform. You agree not to, and not to let anyone else:

  • Use the service, or any access to it, to build, train, or improve a product or service that competes with portablemind.
  • Copy the user interface, system prompts, agent configurations, or orchestration templates that we provide, or use your access to the service to replicate its features in a competing product.
  • Reverse engineer, decompile, or disassemble the service, or attempt to derive its source code, prompts, or underlying structure, except to the extent the law expressly permits despite this restriction.
  • Use output from the service, or agent or orchestration definitions that we supply, to develop or train a competing AI model or service.
  • Sell, resell, sublicense, or provide the service to others, including on a time-sharing, service-bureau, or “wrapper” basis, except under our Platform Partner Terms or another written agreement with us.
  • Scrape, crawl, or bulk-extract the service or its content by automated means, other than through our published APIs and within their limits.
  • Benchmark or test the service in order to build a competing offering, or publish benchmark results, without our written consent.

A product competes with portablemind when it is a general-purpose substitute for the service: an AI-agent, agent-orchestration, workflow-automation, or AI platform offered for broad use. Applications built for a defined use case or market under our Platform Partner Terms do not compete.

These restrictions apply while you have access to the service, and afterwards to anything you obtained through it. They do not stop you from independently building your own products without using ours. Apart from the restriction on using output to develop or train a competing model or service, they do not limit what you do with your own content.

Our service

Portablemind LLC owns the service, including its software, interfaces, and the agents, prompts, orchestration templates, and catalog items we supply. Agents and orchestrations you create yourself are your content. Templates and catalog items we supply remain ours and are licensed to you for use within the service only. Nothing in these terms transfers ownership of the service to you.

If you send us suggestions or feedback, we may use them without restriction or obligation to you.

Your content

You keep ownership of everything you put into the platform. You grant us only the licence needed to operate the service for you — storing it, processing it, backing it up, and transmitting it to the AI providers that serve your requests. We do not use your content to train models, and neither do our providers. Our Privacy Policy sets out the detail.

You are responsible for having the rights to the content you upload, and for its lawful use.

AI output

AI features produce output that can be wrong, incomplete, or misleading. Output is not professional advice — legal, financial, medical, or otherwise. You are responsible for reviewing it before you rely on it or act on it, particularly where an agent has been granted the ability to take actions on your behalf.

AI phone calls and meetings

portablemind lets your organization answer calls with an AI assistant, have AI agents place calls, and hold video meetings that can be transcribed. You decide who is called and why, so you are responsible for making sure each call is lawful. In particular, you agree to:

  • Obtain, and keep a record of, every consent the law requires before an AI agent calls anyone. In the United States this includes prior express consent under the Telephone Consumer Protection Act for calls using an artificial voice, prior express written consent for telemarketing or advertising calls, and the consent of every party where state law requires it for a call to be recorded or transcribed.
  • Record in portablemind only consents that were actually given, with an accurate note of how, and honour a withdrawal of consent as soon as you learn of it.
  • Follow do-not-call rules, including the national Do Not Call Registry, your own internal do-not-call list, and calling-hour restrictions.
  • Not use calling for unsolicited marketing, robocalls, or calls to numbers you have no consent for, and not use it to harass, deceive, or impersonate anyone.
  • Not alter, shorten, or work around the notice at the start of each outbound call that says the caller is an AI assistant and that the call is transcribed. Where you have a number that callers ring, set its greeting to say the same.
  • Tell meeting participants when a meeting is transcribed, and use transcripts only for the purposes they were told about.
  • Comply with the acceptable use policy of our telephony and video provider, Twilio, which is available at twilio.com/legal/aup.

To protect the people being called and the platform, we may apply rate limits and monthly minute limits, cap the length of calls, restrict or block the destinations that can be called, and require consent to be recorded before a call is placed. We may suspend calling or meetings for your organization, without first giving notice, if we reasonably believe they are being used unlawfully, without the required consent, or in breach of these terms.

You will defend and indemnify Portablemind LLC against third-party claims, including claims by regulators, arising from calls placed through your organization's account without the consent the law requires or in breach of this section. Our Privacy Policy describes how call transcripts and meeting information are handled.

Fees and billing

Paid plans are billed in advance on the cycle shown at checkout, through our payment processor. Fees are non-refundable except where required by law or where we say otherwise in writing. Subscriptions renew automatically until cancelled; cancelling stops the next renewal and leaves access in place until the end of the paid period.

Usage-based charges, including AI token consumption above plan limits, are billed as incurred. We will give reasonable notice before changing prices.

Availability

We work to keep the service available and reliable, but we do not guarantee uninterrupted access. We may need to take the platform down for maintenance, and we may change or discontinue features. Where a change materially reduces functionality you rely on, we will give notice.

Termination

You may stop using the service and close your account at any time. We may suspend or terminate access if you materially breach these terms, or if required by law. We may suspend access immediately if we reasonably believe the service is being used to build a competing product or service, or to copy or reverse engineer it. On termination your right to use the service ends; data handling follows the retention section of our Privacy Policy. Ask us before closing an account if you need an export.

Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind to the extent the law allows, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Portablemind LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to these terms will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.

Changes to these terms

We may update these terms as the service develops. We will revise the date at the top, and give notice of material changes. Continuing to use the service after a change takes effect means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. The courts located in Florida will have jurisdiction over any dispute, and both parties consent to that venue.
